Article 1. Definitions

1.1 Topvintage.nl B.V. (“Topvintage”) is an online boutique offering a wide range of women’s fashion, including clothing, shoes, accessories, beauty products & gifts, and lingerie. In addition, Topvintage has a physical store and an outlet store located at Wiebachstraat 9 in Kerkrade, the Netherlands. More information about Topvintage and the current opening hours of our stores can be found on our website.

1.2 These general terms and conditions (hereinafter referred to as the “Terms”) apply to the online activities of Topvintage and are in keeping with the Thuiswinkel General Terms and Conditions, which were drawn up in consultation with the Dutch Consumers’ Association (Consumentenbond).

Article 2. Scope of Application

2.1 All offers, orders and agreements established through www.Topvintage.com are subject to these Terms, to the exclusion of any other general terms and conditions.

2.2 By accepting an offer or placing an order, you accept and agree to these Terms.

2.3 Any deviation from these Terms is only valid if agreed upon in writing. If any part of these Terms is deviated from, the remaining provisions shall continue to be in full force and effect.

Article 3. Agreements

An agreement is entered into as soon as the customer accepts the offer on our website. Topvintage has the right to refuse orders or to request additional information. If an order is not accepted, the customer will be informed of this decision along with the reason for the rejection.

Article 4. Prices

4.1 The prices listed with each item apply to orders within the Netherlands and the European Union and include VAT. For orders placed outside the European Union, VAT is not charged. However, a surcharge is applied, meaning the listed price still applies. Additional import duties, customs fees, or local taxes may be charged for orders outside the EU. These costs are the customer’s responsibility and will not be reimbursed by Topvintage.

4.2 Shipping costs are not included in the listed prices unless stated otherwise. Before completing the agreement, the total price including shipping will be communicated via our website. Depending on the value of your parcel, it may be sent registered and/or insured, and a signature may be required upon delivery. 4.3 Topvintage cannot be held to pricing that is clearly incorrect, for example due to obvious input, typographical or printing errors. No rights may be derived from such inaccurate pricing information.

4.4 Discount codes and promotions cannot be combined, unless explicitly stated otherwise. Discounts cannot be applied retroactively to previously placed orders. The current promotional terms and conditions can be found at: /en/promotion-terms-and-conditions.

Article 5. Payments

5.1 Payment can be made using one (or more) of the methods indicated during the ordering process. Additional payment or ordering conditions may apply to specific methods. After placing an order, the customer will immediately receive an email confirmation stating the total cost, including shipping fees. Payment is possible via:

  • a) Apple Pay: Do you enjoy the convenience of contactless payment and own a compatible iPhone, Apple Watch or iPad? Then you can now use Apple Pay to pay safely and securely in our webshop.
  • b) PayPal: PayPal stands for safe and smart online payments. It’s an easy and free-of-charge payment service that can be used for both domestic and international payments using your bank or checking account.
  • c) MasterCard / Visa / American Express / Carte Bancaire: via MultiSafepay.
  • dTopvintage Gift Card / Store Credit ("Store Credit"): These can be redeemed directly online. Topvintage Gift Cards and Store Credit are transferable and valid for two years from the date of issue. If you haven’t spent the full amount, the remaining balance stays valid — simply enter the same code at checkout to redeem.
  • eAmazon Pay: If you choose to pay via Amazon Pay, you will be redirected to Multisafepay’s secure payment environment. There, you can enter your Amazon login details. Your order will be completed in just a few clicks. Your account details will not be visible to Topvintage, and no data will be stored on our website. 

5.2 By choosing a payment method, the customer authorises Topvintage to carry out all necessary actions to process the payment accordingly.

5.3 For payments made by bank transfer, the payment date is the date on which the amount is credited to Topvintage’s bank account. Payments made via all other methods are processed through MultiSafepay’s secure payment gateway.

5.4 In cases of misuse of buy now, pay later payment methods, including repeated non-payment or fraudulent orders, Topvintage reserves the right — in cooperation with its payment partners such as Riverty and Klarna — to refuse future orders. Any debt collection procedures will be carried out by the relevant payment partner.

Article 6. Delivery

6.1 Topvintage aims to dispatch orders on the same business day and no later than 2 business days after receiving payment. However, this is not a binding obligation.

If your order is completed before 16:30 CEST (Monday-Friday), it will be shipped the same day within the Netherlands. For all other countries, the cut-off time is 15:30 CEST. You will receive an email with each status update, including tracking codes where applicable.

6.2 If delivery is delayed — for example, due to temporary stock shortages or other circumstances — or if an order can only be partially fulfilled, the customer will be informed within seven business days of placing the order. In such cases, the rest of the order (if applicable) will still be shipped. The customer then has the right to cancel the remaining part of the order at no extra cost. Topvintage will arrange for prompt reimbursement if applicable.

6.3. Please always use the track & trace link that you received via e-mail to check the current delivery status. In case your parcel hasn't been delivered during the estimated time frame, please contact us. Does the tracking link show the order as ‘delivered’ but you haven’t received it? Please be sure to contact us within 7 days so we can start an investigation into the missing parcel.

6.4 Deviations in colour, style, text and/or price may occur. Products and/or services are presented and described as accurately and clearly as reasonably possible.

6.5 If a parcel is lost or damaged during transport, prior to being received by the customer, Topvintage is responsible for compensating the value of the items. Once the parcel has been delivered, the risk transfers to the customer.

Article 7. Retention of Ownership

Topvintage retains ownership of all delivered products until full payment has been received. As long as payment has not been made in full, the customer is not permitted to resell, pawn, or otherwise encumber the products.

Article 8. Returning Items

We do our utmost to provide detailed and accurate product information on our website. If, however, an item does not meet your expectations, it can be returned. If a customer is not satisfied, we offer a money-back guarantee on all items. This also applies to discounted/sale items.

Return policy:
All items can be returned, provided that your return parcel is delivered to Topvintage within 30 days of receipt and the following conditions are met:

8.1 The following conditions apply to returns:

8.1.1) Return instructions
Please use the enclosed return form to indicate the reason for your return. Payments made by credit card or PayPal will only be refunded to the original credit card or PayPal account. Make sure to package your item(s) properly and include the return form in the parcel – otherwise we will be unable to process your return. Hand in your parcel at your nearest post office or parcel drop-off point. Return shipping costs are the customer’s responsibility. If you live in the Netherlands, Belgium or Germany and use our return label, a €4.95 fee (for parcels up to 30 kg) will be deducted from your refund.

8.1.2) Return deadline
Items must be delivered back to Topvintage as soon as possible, but no later than 30 days (Monday to Friday, excluding Sundays and public holidays) after receipt. Returns that are shipped outside this return period will not be accepted unless agreed upon in advance.

8.1.3) Return conditions
Returned items must be in their original condition: unworn, unused, and free of perfume, cigarette smell or other signs of wear. All original tags must still be attached. If applicable, the hygiene strip must still be present. Packaging must be undamaged and in pristine condition. Items with torn or damaged packaging that are no longer sellable, as reasonably determined by us, will not be accepted for return. Shoes may be tried on indoors but cannot be returned if worn outside.
When trying on clothing, please take care not to use excessive perfume, avoid getting make-up on the fabric, and be mindful of jewellery that might cause damage. Topvintage reserves the right to refuse returns based on the above points or in the case of suspected use and/or to charge for repairs or reduction in resale value.

For hygiene reasons, we are unable to accept returns of hosiery once the packaging has been opened.

Please do not open the packaging of the following items for hygiene reasons:

- Tights
- Hold-ups 
- Seamed stockings
- Suspender stockings
- Socks and ankle socks
- Make-up
- Underwear (briefs)
- Earrings

The items listed above must be returned in their original condition, unopened in the original packaging with the seal intact. If these requirements are not met, the refund will be refused, and the item will not be returned. Books are also excluded from our return policy and cannot be returned. Due to fraude risk, gift vouchers are not accepted for return as well. 

8.1.4) Return confirmation and refund
Once we have received your return, it will be inspected to make sure the conditions stated above are met. You will receive a confirmation email as soon as possible, but no later than 7 business days after your return parcel has been delivered to us. This email will be sent once your return has been fully processed and refunded. Return shipping costs are the customer’s responsibility.

8.2.1) If an order for which shipping costs were charged is returned in full, the shipping costs will be refunded to the customer.

8.2.2) Topvintage is not responsible for return parcels that are lost when using your own return label. The customer is responsible for proper packaging and shipping of the return parcel. If the parcel is returned using the Topvintage return label, responsibility lies with Topvintage.

Article 9. Complaints

Complaint regarding delivery
9.1 At Topvintage, we do our utmost to deliver quality products. Upon receipt, please inspect your items immediately and notify us by email of any defects right away. If an item you ordered hasn’t been delivered or does not match the description on our website, please contact us as soon as possible — either by phone, WhatsApp, website chat (available Monday to Friday, from 09:00 – 17:00 CEST, excluding Dutch public holidays), or by email at [email protected]. Please don’t forget to include your order number.

Complaint regarding product quality:
Of course, it’s possible that the quality of a garment may no longer meet your expectations after a certain period of use — for example, if it shows signs of excessive wear after limited use, a button or zipper breaks, or the item does not hold up well after washing.

Topvintage offers a 3-month warranty period. This does not affect your statutory rights in the event of non-conformity. The warranty applies only to normal use and washing frequency. The expected lifespan of the item must also reasonably fall within this 3-month period.

Items of clothing must be washed according to the care instructions on the label. If a different washing method is chosen, any complaint will be considered invalid.

The warranty will lapse if the customer attempts to repair the issue without consulting Topvintage first and/or fails to follow the care or usage instructions.

Article 10. Cancelling your order

You may cancel your order at any time, without providing a reason and without incurring any fees, as long as payment has not yet been completed. An order can only be cancelled if it has not yet been processed and shipped.
If the order has already been shipped, the return conditions outlined in Article 8 apply.
We kindly ask you to inform us of your cancellation as soon as possible. You can do so by email at [email protected] (please include your order number), or by phone, from the Netherlands: +31 (0)45 750 720 8. From Belgium: +32 (0)38 08 19 34 and from all other countries: +31 (0)45 750 720 8. (Available Monday-Friday from 09:00 - 17:00 CEST, excluding Dutch public holidays).

Article 11. Right of Withdrawal

11.1 In accordance with distance selling regulations, the customer has the right to withdraw from the purchase of new items within 30 days of receiving the order, without incurring any fees and without having to provide a reason. In such cases, the customer is entitled to a full refund of the order amount. Topvintage will also refund the original shipping costs.

11.2 The item must be returned to Topvintage within 30 business days of receipt at the delivery address, at the customer’s expense. You will receive a confirmation email once we have received and processed your return. If all conditions have been met, the refund will be issued no later than 7 business days after the return has been received by Topvintage.

11.3 The right of withdrawal expires if the conditions described in Article 10 are not fully met. In such cases, your return will be considered a return in accordance with Article 8 of these Terms.

Article 12. Orders/Communication

After placing an order, the customer will receive a confirmation by email.

If the customer makes a mistake during the ordering process, the customer must inform Topvintage as soon as possible. Topvintage will make every effort to correct such mistakes but there is no guarantee that this will be possible due to the automated nature of the process. Topvintage reserves the right to cancel an order in the event of obvious mistakes, such as unrealistic pricing or product unavailability.

Article 13. Force Majeure

In the event of force majeure, Topvintage reserves the right — at its sole discretion — to suspend the fulfilment of the customer’s order or to dissolve the agreement without judicial intervention. In such cases, the customer will be informed in writing, Topvintage will not be liable for any form of compensation, unless this would be contrary to the principles of reasonableness and fairness.

Article 14. Privacy Policy

Topvintage processes personal data in accordance with the General Data Protection Regulation (GDPR, known in Dutch as AVG). For more information about how we process personal data, please refer to our privacy policy at: /en/privacy-policy.

Article 15. Governing Law and Jurisdiction

15.1 All rights, obligations, offers, orders, and agreements to which these Terms apply — as well as these Terms themselves — are governed exclusively by Dutch law, except where mandatory provisions from the consumer’s country of residence apply.

15.2 If you are not satisfied with our products or services, please contact us as soon as possible, preferably by email at: [email protected].

15.3 Any disputes between the parties may be submitted to the competent court in the Netherlands.

15.4 If any provision of these Terms is declared invalid or void by a court ruling:

  • all remaining provisions shall remain fully in effect,
  • Topvintage and the customer will consult with each other to agree on new provisions to replace the invalid or void provisions, reflecting the purpose and intent of the original provisions as closely as possible.

Topvintage reserves the right to modify or supplement these Terms and Conditions at any time. We therefore recommend that you review the Terms and Conditions regularly. By continuing to use our website after such changes have taken effect, you unconditionally accept the amended Terms and Conditions.
